Terms & Conditions
Last Updated: 25 July 2025
Effective Date: 25 July 2025
These Terms and Conditions govern the use of this website and the engagement of estate records and document support services provided by Heirloom Atlas. By using this website or commissioning an engagement, you agree to these terms. Please read them carefully before proceeding.
1. Definitions
- "We", "us", "our" — Heirloom Atlas, Suite 12-4, Menara Amcorp, 18 Jalan Persiaran Barat, 46050 Petaling Jaya, Selangor, Malaysia.
- "You", "client" — the individual or family who commissions an engagement or uses this website.
- "Engagement" — any of the three service types: Estate Records Inventory, Legacy Document Archive and Digitisation, or Executor Administrative Support Programme.
- "Scope" — the written document confirming what is included in a specific engagement, agreed before work begins.
- "Deliverable" — the written output produced at the close of an engagement (inventory, indexed archive, closing archive or report).
2. Acceptance of Terms
By submitting an enquiry through this website or by signing the engagement scope, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement. These terms apply to all website users and to all clients who commission an engagement.
3. Description of Services
Heirloom Atlas provides estate records organisation and document support services only. The three engagements available are:
- Estate Records Inventory (RM 480): A structured catalogue of documents associated with a family estate. Completed within 2–3 weeks of access.
- Legacy Document Archive and Digitisation (RM 1,960): Archival scanning, naming, indexing and delivery of a digital archive. Completed within 6–8 weeks.
- Executor Administrative Support Programme (RM 4,350): Six months of clerical support for the executor's workload.
Services are available to clients in Selangor and the Klang Valley. Engagements in other locations may be possible subject to prior discussion and agreement.
4. Scope of Work and Limitations
Each engagement is descriptive and organisational only. We do not:
- Provide legal advice, legal opinions or legal representation
- Value assets or produce valuations of any kind
- Provide accounting, financial or tax advice
- Act on behalf of the client in dealings with any institution or authority
- Interpret documents or advise on the meaning of their contents
Where a matter requires a qualified professional, we will say so clearly. The client is responsible for engaging appropriate professional advisers for legal, financial and other regulated matters.
5. Client Responsibilities
- Provide accurate information about the estate and the documents available for the engagement.
- Ensure that access to documents is legitimately authorised — that you have the right to provide access to the materials included in the engagement.
- Review the written scope before signing and raise any questions before the work begins.
- Use this website for lawful purposes only and not attempt to access systems or data not intended for you.
6. Payment Terms
Engagement prices are fixed as stated. Payment terms are confirmed in the written scope prior to commencement. Prices are in Malaysian Ringgit (RM) inclusive of applicable taxes where required.
Cancellation after the scope has been signed and work has begun may result in a partial charge proportional to the work completed. The specific terms are set out in the engagement scope.
7. Intellectual Property
All content on this website — including text, layout and structure — is owned by Heirloom Atlas. You may not reproduce, distribute or use website content without our written permission.
The deliverable produced from your engagement is provided to you for your own use. The naming conventions, index structures and working methodologies used to produce it remain the intellectual property of Heirloom Atlas.
8. Confidentiality
All personal and estate information provided to us during an engagement is treated as confidential and handled under a written confidentiality agreement. We will not disclose client information to third parties except where required by Malaysian law or regulatory authority.
9. Disclaimers
Our services are provided in good faith based on the information and access provided. We make no representation about the completeness of an estate's records beyond what is found during the engagement. The presence or absence of a document in the inventory does not constitute a legal or financial assessment.
This website is provided "as is" without warranties of any kind regarding its availability, accuracy or fitness for a particular purpose.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law, our total liability in connection with any engagement shall not exceed the amount paid for that engagement. We are not liable for indirect, consequential or incidental losses arising from the use of our services or this website.
11. Termination
Either party may terminate an engagement by written notice. The specific termination terms and any applicable charges are set out in the written scope. Upon termination, all materials in our temporary custody are returned to the client.
12. Governing Law and Disputes
These terms are governed by the laws of Malaysia. Any dispute arising from them shall be subject to the exclusive jurisdiction of the courts of Malaysia.
We encourage informal resolution of any concern before formal proceedings. Please contact us at [email protected] in the first instance.
13. Changes to These Terms
We may update these terms from time to time. Changes will be reflected in the Last Updated date above. Continued use of the website or engagement of our services after changes are posted constitutes acceptance of the revised terms.
